How We Deal With Nuisance Complaints
If you make a complaint about a tenant we will normally write to them (without telling them your name and address). We will tell them about the complaint and ask them to discuss it with their housing officer. We will warn them that we may take legal action if the complaint is true, we will also ask them to sign an 'Acceptable Behaviour Agreement'. We will then tell you this has happened and ask you to write in with details of any more nuisance.
If more nuisance happens we may give the tenant who is causing the nuisance notice that we are trying to get a possession order (an order to evict them) or an injunction to stop the nuisance. We may then get a suspended possession order, where the tenant will be evicted the first time the nuisance happens again, or we may evict the tenant straight away.
If we get an injunction, the tenant or whoever is causing the nuisance may be arrested. We will ask you if you are prepared to go to court and give evidence as this will make successful legal action more likely. We do investigate nuisance complaints from only one tenant, but try to get independent witnesses who will support you. The court usually needs this before it will give a possession order.
