Individual rights under the Data Protection Act 1998
The Act gives individuals the following rights in respect of the personal data that the council holds on them. These rights are:
- Right of subject access.
- Right to prevent processing likely to cause damage or distress.
- Right to prevent direct marketing.
- Right to have automated decision taking checked by a person.
- Right to take legal action for compensation if an individual suffers damage (or damage and distress) as a result of any contravention of the Act by the council.
- Right to take legal action to seek the rectification, blocking, erasure or destruction of inaccurate personal data.
