Unitary Development Plan (UDP)
The Lambeth Unitary Development Plan (UDP) is part of the development plan for Lambeth. The development plan for Lambeth is made up of the London Plan, The Lambeth Core Strategy (Adopted 19 Janury 2011) and the remaining saved, non superseded policies in the Lambeth UDP, which is now referred to as the Lambeth Unitary Development Plan 2007: Policies saved beyond 5 August 2010 and not superseded by the LDF Core Strategy January 2011.
Anyone proposing to submit a planning application is advised to refer to the London Plan, the Core Strategy and the UDP Saved Policies, as this will be the basis upon which planning applications will be determined.
Saved Polices
The Lambeth Unitary Development Plan (UDP) was adopted by Lambeth Council on 6 August 2007.
All the policies contained in local plans and unitary development plans are saved for three years after adoption by virtue of the Planning and Compulsory Purchase Act 2004. If local authorities wish to retain specified policies beyond the expiry of the three year period, they must seek the Secretary of State's agreement to issue a direction to this effect. Local authorities are required to demonstrate that the policies they wish to save, reflect the principles of the local development frameworks and are consistent with current national policy. Policies that duplicate national or regional guidance cannot be saved.
The council submitted a list of policies that it wished to save accompanied by justification for their retention to the Secretary of State in February 2010. The Secretary of State responded in July 2010 issuing a Direction listing the policies to be saved for a further three years.
The policies that have not been saved no longer form part of the development plan and will not be used in the assessment and determination of planning applications with effect from 6 August 2010.
Superseded Policies
On adoption in January 2011, the Lambeth Core Strategy superseded a number of the Saved UDP Policies. The status of each UDP policy is set out in Annex 10 of the Core Strategy. An amended version of the UDP had been issued in which those policies that are no longer in use - either because they have not been saved of because they have been superseded by the Core Strategy - have been struck through. This is referred to as the Lambeth Unitary Development Plan 2007: Policies saved beyond 5 August 2010 and not superseded by the LDF Core Strategy January 2011.
The Local Development Framework Proposals Map 2011 incorporates adopted Core Strategy and Saved UDP policies and MDOs as of January 2011.
The UDP, Core Strategy and Proposals Map are available for inspection at the Lambeth Planning Office, Phoenix House, 10 Wandsworth Road, London SW8 2LL (by appointment only).
