CIL examination library 2021 

Lambeth Council formally approved a revised Community Infrastructure Levy (CIL) Charging Schedule following a full Council meeting held on 22 September 2021. The full decision report is available to view online.

Examiner's Report

On 18 June 2021, the Council received the CIL Examiner's final report. The report contains the Examiner's recommendations and detailed reasons for those recommendations. No recommendation for any further modification of the rates was made. The Examiner concluded that the "proposed rates will not put the majority of developments at risk, and it can be recommended for approval."

Modified Draft Charging Schedule (MDCS) 2021

Lambeth Council submitted a Modified Draft Charging Schedule (MDCS) for independent examination on 8 March 2021. The submission includes a Statement of Modifications to the Draft Charging Schedule. Persons who were invited to make representations during the previous consultation on the Draft Charging Schedule (DCS) in 2020 have been notified of the modifications. Any person may request to be heard by the CIL Examiner in relation to the modifications set out in this document.

MDCS 2021 was examined by Mr Terrence Kemmann-Lane, JP DipTP FRTPI MCMI.

Programme Officer

The Programme Officer (PO) for the CIL examination was Ms Carmel Edwards who reported directly to the Examiner. Ms Edwards took charge of the day-to-day organisation of the examination and acted as a channel of communication between the Examiner and all parties, including Council officers and representors.

Hearing sessions

The Examiner decided not to proceed with the public hearing scheduled for 25 May 2021. This is due to the absence of other respondents wishing to take part, and the written responses to the issues highlighted in the hearing agenda that have already been provided to the Examiner.

News

22 September 2021: A full meeting of the Council passed a resolution approving Lambeth's new CIL Charging Schedule as recommended by the CIL Examiner. This will come into force from 1 January 2022.

13 September 2021: The Cabinet of the Council agreed to recommend a resolution by the full Council to approve the new CIL Charging Schedule with a date of effectivity on 1 January 2022.

18 June 2021: The Council received the Examiner's Report.

25 May 2021: The Examiner accepted the Council’s submission of the opening statement (EX 14) that was to be delivered during the hearing. This can be viewed in the CIL Examination Library 2021.

24 May 2021: The Examiner, with agreement of the Council, has decided not to proceed with the scheduled CIL examination hearing on 25 May 2021.

21 May 2021: The Examiner invited the Council to comment on his Hearing agenda, to assist in focusing the discussion. Their response (EX 13) can be viewed in the CIL Examination Library 2021.

13 May 2021: The Examiner has asked further questions of the Council in relation to issues raised in EXR 04. This was the response to the Examiner’s Questions from Coin Street Community Builders. His further questions and Council responses (EX 12) can be viewed in the CIL Examination Library 2021.

10 May 2021: The Examiner has now published his agenda for the hearings (EX 11). This can be viewed in the CIL Examination Library 2021.

4 May 2021: The Examiner has set a date of Tuesday 25 May for the public hearing into the Draft Charging Schedule. This will take place virtually via Microsoft Teams and will be live streamed. There will be a link to the live stream on this page.

26 April 2021: Responses have been received to four of the Examiner’s Questions which he issued on 13 April 2021. These can be viewed in the CIL Examination Library 2021.

13 April 2021: The Examiner has produced 10 Examiner’s Questions which have been sent directly to relevant parties. These can be viewed in the CIL Examination Library 2021.
