Term time only backpay frequently asked questions

The following question and answer sheet is to be used as a guide for dealing with term time only support staff pay queries. 

Who do I make my claim against? 

The claim with ACAS must either be against Lambeth Council or your former/current school(s).

However, if you are owed TTO payments for more than one school and you put in a single claim against one of the two (or more) this is not sufficient for Lambeth Council to be able to process your claim/ payment for the other separate school(s).

E.g. Fred Bloggs is a current employee at Crown Lane School and he or his Union have made a claim to ACAS against Crown Lane as he has been a TTO worker there from 1 January 2018 - now. Fred will receive a personal offer letter with a TTO backpay amount for between 1 January 2018 – 31 March 2020.

Fred was also employed at Fenstanton School from 1 January 2015 – 31 December 2017 as a TTO worker. Therefore, he or his Union need to put a separate claim to ACAS against Fenstanton School (not against the London Borough of Lambeth/Lambeth Council) for his TTO backpay to cover the period 1 January 2015 – 31 December 2017. If this is done Lambeth can make an offer to Fred for his Fenstanton payment.

A single claim to ACAS against Lambeth Council will cover both Crown Lane School and Fenstanton School.
